These Terms of Service (which we call the “Terms”) govern your use of Tulin. These Terms of Service form a legally binding agreement between you (“your”, “user”) and us (“we”, “our”).

Agreement to Terms

By using the Tulin mobile application (“App”), the Tulin website (“Site”) and Tulin services (we refer to these collectively as the “Services”), you are deemed to have carefully read and accepted the Terms, if you don’t agree with them, then don’t use the Services.

Who Can Use the Services

You must have at least 13 years age for use the Services, if you are under age 18, you may only use the Services with the consent of your parent or legal guardian. If you are using the Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms. You must not be a convicted sex offender.

Privacy Policy

Providing our Services requires collecting and using your data. Please refer to our Privacy Policy for information on how we collect and use your data. By using our Services you are deemed to have carefully read and accepted our Privacy Policy.

Copyright Policy

Tulin respects the rights of others and so should you. You therefore may not use the Services, or enable anyone else to use the Services, in a manner that violates or infringes someone else’s rights of publicity, privacy, copyright, trademark, or other intellectual property right. When you submit content to the Services (including but not limited to photos, videos and sounds), you are solely responsible for ensuring and must ensure that you own that content, or that you have received all necessary permissions, clearances, and authorizations in order to submit it to the Services and grant the rights and licenses contained in these Terms for your content.
Tulin honors copyright laws, including the Digital Millennium Copyright Act and takes reasonable steps to expeditiously remove from our Services any infringing material that we become aware of. If Tulin becomes aware that a user has repeatedly infringed copyrights, we will take reasonable steps within our power to terminate the user’s account. If you believe that anything on the Services infringes a copyright that you own or control, please report it at this email, your email must:

• Contain the physical or electronic signature of a person authorized to act on behalf of the copyright owner.
• Identify the copyrighted work claimed to have been infringed.
• Identify the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, or access to which is to be disabled, and information reasonably sufficient to let us locate the material.
• Provide your contact information, including your address, telephone number and an email address.
• Provide a personal statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• Provide a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

General Prohibitions

The following prohibitions apply to everyone and everything shared on Tulin.
You agree not to do any of the following:

• Violates or infringes someone else’s rights of privacy or other intellectual property right.
• Violate or infringe Tulin intellectual property rights such as trademarks.
• Use the Services for any commercial purposes without our written consent.
• Distribute, license, transfer, or sell, in whole or in part, any of the Services or any derivative works thereof.
• Market or rent the Services for a fee or charge.
• Be under the age of 13.
• Share sexually explicit material.
• Post photos or videos involving minors in activities related to sexual acts.
• Post photos or videos involving the mistreatment or exploitation of animals.
• Break the local law in any way or be part of a criminal group.
• Promote crime, violence, dangerous acts, self-harm or discrimination.
• Intimidate, bully or harass someone.
• Spam.
• Make misinformation through fake news.
• Collect or store any personally identifiable information from other users of the Services.
• Impersonate others.
• Use a domain name or URL in your username.
• Create a dangerous challenge or a challenge that appears inappropriate.
• Use automated scripts to interact with the Services.
• Buying or selling accounts and followers.
• Access or use non-public areas of the Services.
• Make unauthorized copies, modify, adapt, reverse engineer, disassemble, decompile or create any derivative works of the Services.
• Attempt to determine any source code, algorithms, methods or techniques embodied by the Services.
• Interfere with or attempt to interfere with the proper working of the Services, disrupt our Site or our App.
• Use the Services to make available in any way files that are malicious or technologically harmful, including without limitation: viruses, trojans, worms or other material.

Community Guidelines

Tulin is not obligated to monitor the use of the Services or to review or edit any content, however, we have the right, at any time and without prior notice, to disable access to content, in whole or in part, at our discretion for any reason or no reason. Some of the reasons we may remove or disable access to content may include finding the content in violation of these Terms, our Community Guidelines or otherwise harmful to our users. We may also consult and cooperate with local law authorities to prosecute users who violate the law. By using our Services you are deemed to have carefully read and accepted our Community Guidelines.

Challenges

A challenge consists in sharing on the App a photo or video in which the user performs one or more actions chosen by the challenge creator, we will refer to this process done by the user as “join a challenge” or “joining a challenge”.
A user can create one or more challenges in the App and customize them by: choosing a name, writing a description, choosing a cover image and making a sample post, we will refer to this process done by the user as “create a challenge” or “creating a challenge”.
A challenge that represents a security threat to users or appears inappropriate is removed as soon as possible from the App after being noticed by Tulin itself or after being reported by users.
To the maximum extent permitted by law, Tulin will not be liable for any damage (including without limitation: bullying, stalking, mistreatment or exploitation of animals, harassment that is sexual or otherwise, acts of physical violence, physical damage of any kind, death and destruction of personal property), suits, claims, and/or controversies, whether known or unknown, that have arisen or may arise out of or in connection with: a user joining a challenge, a user who creates a challenge, our inability to remove a challenge even after receiving one or more reports (in the App or in any other form) and our inability to mark a challenge in the App as a “potentially dangerous challenge” despite the case requiring it. By using our Services you acknowledge and agree with: you (and not us) are responsible for any damage to your person or to third parties caused by joining or creating a dangerous challenge in our Services. We highly recommend you to join or create only safe challenges. If you find a potentially dangerous challenge, please report it immediately in the app.

Usage Time

As with any social, prolonged use of the Services without breaks and hours of sleep could cause psychological damage. You are solely responsible for any damage caused by prolonged use of the Services.

Disclaimers

We try to keep the Services up and running and free of annoyances. But we make no promises that we will succeed.
The Services are provided “as is” and “as available” and to the extent permitted by law without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, while we attempt to provide a good user experience, we do not represent or warrant that: (a) the Services will always be secure, error-free, or timely; (b) the Services will always function without delays, disruptions, or imperfections; or (c) that any content, user content, or information you obtain on or through the Services will be timely or accurate.
Neither we nor our affiliates take responsibility or assume liability for any content that you, another user, or a third party creates, uploads, posts, sends, receives, or stores on or through our Services. You understand and agree that you may be exposed to content that might be offensive, illegal, misleading, or otherwise inappropriate, none of which we or our affiliates will be responsible for.

Indemnity

For the purposes of this Section, "Tulin", "we", or "us" shall include Tulin, our employees, directors, affiliates, investors, agents and suppliers. You agree to indemnify, defend and hold harmless Tulin from any and all complaints, claims, charges, losses, damages, costs, liabilities, and expenses including, but not limited to attorneys’ fees, due to, arising out of, or relating in any way to: your use of the Services, your content and your breach of these Terms.

Limitation of Liability, Class Action Waiver

To the maximum extent permitted by law, Tulin will not be liable for any incidental, special, exemplary or consequential damages, or damages for lost profits, lost revenues, lost savings, lost business opportunity, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute services of any kind arising out of or in connection with these terms or from the use of or inability to use the services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Tulin or any other party has been informed of the possibility of such damage. If, notwithstanding the foregoing exclusions, it is determined that any Tulin party is liable for damages, in no event will the aggregate liability, whether arising in contract, tort, strict liability or otherwise, exceed one hundred u.s. dollars ($100.00).

Data Charges

You are responsible for any mobile charges that you may incur for using our Services, including text-messaging (such as SMS and MMS) and data charges. If you’re unsure what those charges may be, you should ask your service provider before using the Services.

Feedback

If you choose to contribute to the community by sending us or our employees ideas, suggestions, comments, strategies, computer codes, artworks, documentations, or other materials (we refer to these collectively as the “Feedback”), then regardless of what your accompanying communication may say, by sending us Feedback the following terms will apply. We have no obligation to consider or to implement your Feedback. You irrevocably grant us an unlimited permission to reproduce, distribute, create derivative works of, modify, communicate to the public, make available, publicly display, and otherwise use and exploit the Feedback and derivatives thereof for any purpose and without restriction, free of charge and without attribution of any kind.

Links to Third Party Websites or Resources

The Services may allow you to access third-party websites or other resources. Users of the Services may provide access through their User Profile to third-party websites potentially dangerous. You acknowledge sole responsibility for and assume all risk arising from, your use of any third-party websites or resources.

Open Source

The Services contain certain open source software. Each item of open source software is subject to its own applicable license terms.

App Store

By accessing the App from Apple’s App Store you acknowledge and agree that:

• These Terms are between Tulin and you, and not with Apple.
• Tulin is solely responsible for the App. Apple has no obligation to furnish any maintenance or support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any) and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or a third party relating to the App or your possession or use of the App, including without limitation (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
• In the event of any third party claim that the App or your possession and use of the App infringes such third party’s intellectual property rights, Apple is not responsible for the investigation, defense, settlement or discharge of such intellectual property infringement claim.
• You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third party beneficiaries of these Terms, so by using the App you recognize their right to enforce this Terms against you as a third-party beneficiary of these Terms of Service.

Updating These Terms

We may change or amend these Terms of Service from time to time in our sole discretion, so we encourage you to review them periodically for any updates or changes. When we make changes to these Terms, we will post the updated terms in our Site. Then if you continue to use our Services, you will be bound by the updated Terms. Your continued use of the Services following the posting of any notice of any change to The Terms shall constitute your acceptance and agreement to such change. If you don' t agree any provision of the Terms, don' t use or stop using the Services by deactivating your Tulin account.

Termination

You can terminate these Terms at any time by deactivating your Tulin account. We may also terminate these Terms with you at any time, for any reason, and without advanced notice. That means that we may terminate or suspend, in whole or in part your access and use of the Services. Notwithstanding the foregoing, all sections of the Terms which by their nature should survive the expiration or termination shall continue in full force and effect subsequent to and notwithstanding the expiration or termination of these Terms.
